What the rules actually say.

The succession layer comes first

Whether the inheritance is under a will (with probate where required) or intestate (under personal-law succession), the legal transfer must be completed before banks will release funds or registrars will mutate property. This is often the slowest step.

Routing inherited funds

Inherited bank balances and sale proceeds of inherited property normally flow into NRO. From NRO, they can be repatriated up to USD 1 million per financial year per person, with the standard Form 15CA / 15CB and a CA-issued source-of-funds certificate.

Inherited agricultural land

OCIs can inherit agricultural land, plantation property and farmhouses from a person eligible to hold them. They can continue to hold and use these, but resale and repatriation of proceeds are restricted under FEMA.

Can I skip Indian succession and just transfer funds abroad on the basis of a foreign will?
No. Indian banks and registrars require Indian succession documentation (probate, legal-heir certificate, succession certificate) for Indian assets, regardless of where the will was drafted.
Is inherited money taxed in India?
Inheritance itself is not taxed in India. Income generated by the inherited assets (rent, interest, capital gains on later sale) is taxed normally.
Can multiple heirs each use the USD 1 million limit?
Yes — each individual NRI / OCI heir has their own per-year cap, applied to assets they own personally after succession.
