What is OCI / FEMA?

OCI basics: what the card actually means for your money

Direct answer. OCI is a lifelong visa and access status — it is not Indian citizenship and it is not a tax-residency shield. Your Indian bank accounts, property and money movements still run through FEMA based on your residential status, not the card.

Who this applies to

If any of these sound like you.

  • OCI cardholders, new or long-standing
  • PIO holders considering OCI conversion
  • Indian-origin foreign citizens with assets in India
The detail

What the rules actually say.

01

What OCI actually gives you

Lifelong multi-entry visa to India, parity with NRIs for most economic, financial and educational rights, and freedom from FRRO registration. It does not give voting rights, agricultural land ownership, or automatic Indian tax residence.

02

Where OCI does not change the rules

Bank account eligibility is set by FEMA residential status (resident vs non-resident), not by OCI. Tax residency is set by physical-presence tests under the Income-tax Act. RBI-regulated transactions (FDI, large remittances, certain property types) follow FEMA notifications regardless of card status.

03

The practical mental model

Treat OCI as a passport-and-visa convenience. For every money question, ask three separate questions: am I a FEMA resident or non-resident, am I an Indian tax resident this year, and which RBI route applies to the transaction.

Common questions

Answered, candidly.

Does an OCI card make me an NRI?
No. NRI is a FEMA / Income-tax classification driven by where you live and how long you stay in India. Two OCI holders can have completely different NRI / resident status in the same year.
Can OCIs buy any property in India?
Residential and commercial property — yes, like NRIs. Agricultural land, plantation property and farmhouses — no, unless inherited under specific conditions or by special RBI approval.
Do OCIs need RBI permission to remit savings out of India?
Not for routine NRE / FCNR balances. For NRO balances above the USD 1 million per financial year limit, or for certain sale-proceeds and inheritance flows, additional documentation or approval may apply.
