Qatar–India Tax, FEMA & Financial Advisory for NRIs & OCIs.

Working in Qatar does not by itself establish NRI status: Indian tax residency follows Section 6 day-counts and, where applicable, deemed-residency rules. Plan RNOR, NRE accounts, end-of-service benefits and repatriation before the move.

Indian tax residency for someone working in Qatar depends on Section 6, not visa status or the absence of Qatar salary tax. Check the 182-day and 60-plus-365-day tests with applicable exceptions; Section 6(1A) may give RNOR to an Indian citizen with income other than foreign-source income above Rs 15 lakh who is not liable to tax elsewhere by reason of residence, domicile or a similar criterion. Review income source, first receipt and RNOR before your return.

Qatar and India tax

Returning from Qatar: the Indian tax steps in order.

Your Indian tax status depends on Section 6, not on Qatar salary being untaxed locally. Count India days, check any deemed-residency condition and review the source and receipt of your final payout.
  1. 01

    Count your India days

Section 6 makes you resident if you spend 182 days or more in India in the financial year, or 60 days plus 365 days over the previous four years (the 60-day limb is extended for some visiting citizens and OCIs). The landing date can shift a whole tax year.

  2. 02

    Check deemed residency

Section 6(1A) can treat an Indian citizen with Indian income above Rs 15 lakh, who is not liable to tax in any country, as resident. Deemed residency always gives RNOR status, not full resident status.

  3. 03

    Redesignate your accounts

Within 30 days of returning, redesignate NRE and FCNR accounts to resident or RFC accounts and tell your Indian banks and brokers.

  4. 04

    Time the end-of-service payout

An end-of-service benefit for overseas employment is generally outside Indian tax for a non-resident if it neither accrues nor is first received in India. Review the service period, source, first receipt and residency in the receipt year before you resign.

  5. 05

    Review Schedule FA later

Schedule FA is not required while you are NR or RNOR. Review foreign-asset reporting from the first Resident and Ordinarily Resident year, separately from whether your overseas income is taxed.

Check your window with the RNOR calculator or read RNOR status explained.

NRI Come Back Plan

Returning to India from Qatar.

What makes a permanent return from Qatar different, from more than 250 NRI Come Back Plans prepared by Regi Tom Antony & Associates in the last ten years. Regi returned to India himself after around 20 years abroad.

  • 01No Qatar income tax means no foreign tax credit: once fully resident, income from assets left in Qatar is taxable in India in full.
  • 02End-of-service gratuity and final settlements: time their receipt against your residential status and keep the employer documents.
  • 03Close or redesignate NRE and FCNR accounts in step with your status change, and track foreign assets for Schedule FA from the first ROR year.

In depth

Why Qatar residents face different questions

Qatar levies no personal income tax on employment income, so there is no foreign tax to credit in India — planning is about staying non-resident while abroad and keeping Indian income clean. Section 6(1A) treats an Indian citizen with Indian income above ₹15 lakh, who is not liable to tax in any country, as resident (and RNOR). Indian-source rent, NRO interest and capital gains stay taxable in India throughout.

Treaty claims and residency certificates

The India-Qatar DTAA can matter for treaty rates on Indian-source income and for tie-breaker residency in a move year. Claiming treaty benefits in India generally needs a tax residency certificate from the Qatar authorities plus Form 10F. Apply before the Indian transaction rather than after it, and confirm the position for your facts.

End-of-service benefits and the move home

An end-of-service benefit received while you are non-resident is outside Indian tax. On return, review the final settlement date and any FCNR maturities against your residency and RNOR position, redesignate NRE and FCNR accounts within 30 days, and consider holding foreign-currency balances in an RFC account rather than converting everything to rupees on day one.

Common questions

Answered, candidly.

Am I an NRI if I work in Doha?
Working in Qatar does not by itself decide NRI status. Apply Section 6's 182-day or 60-plus-365-day tests, the exceptions for qualifying employment departures and citizen/PIO visits, and any deemed-residency rule. Visa status does not decide Indian tax residency.
Does deemed residency apply to me?
Section 6(1A) requires Indian citizenship, total income other than income from foreign sources exceeding Rs 15 lakh, and no liability to tax elsewhere by reason of domicile, residence or a similar criterion. Paying no local salary tax is not alone decisive. Where it applies, you are RNOR, not ROR.
What happens to my NRE account when I return?
Within 30 days of becoming resident, redesignate NRE and FCNR accounts to resident or RFC accounts and update your bank and broker records.
Does the DTAA matter if there is no local income tax?
Yes, in narrower ways. The India-Qatar DTAA can matter for tie-breaker residency, treaty rates on some Indian-source income and business structures. A tax residency certificate is usually needed to claim treaty benefits; confirm the position for your facts.
If I return mid-year, am I resident for the whole year?
Not automatically — the 182-day and 60+365 tests apply. Mid-year returns often qualify as NRI for that year if you've been overseas long enough.
